Foundations of Constitutional Structure

This unit introduces students to the text, history, and organizing principles of the U.S. Constitution and places constitutional law in its broad institutional and historical context. It builds on foundational civic knowledge and prepares learners to apply constitutional doctrines and doctrines to case-based analysis in subsequent units.

Learning Objectives

• Analyze the text and organization of the U.S. Constitution by identifying the purposes of key articles and amendments and explaining the institutional roles of the legislative, executive, and judicial branches.
• Compare and contrast the Articles of Confederation and the Constitution and evaluate major Federalist and Anti‑Federalist arguments to explain how historical choices shaped the structure of the federal government.
• Map and differentiate core constitutional concepts and distinctions — including federalism vs. state sovereignty, separation of powers, judicial review, enumerated vs. implied powers, and procedural vs. substantive protections — using graphic organizers to show relationships.
• Evaluate the constitutional reach of national government powers by applying clauses such as Commerce, Necessary and Proper, Taxing and Spending, and Supremacy to hypothetical fact patterns to determine limits and interactions with state authority.
